And speaking of seat-belt laws...Wear it or be Tasered!

June 19, 2010: And on a lighter note...Wear your seat-belt or be Tasered!
Well not exactly. But apparently a seat-belt violater in San Diego, after being stopped by the police for not wearing his seat-belt, and then exiting his vehicle and proceeding to act strangly and then approaching the police officer, who told him to stop, but he didn't, so...he was Tasered.
Ouch!
So then he sued.
then lost.
then won.
and now lost!
or something like that.

Bottom line is...ALWAYS wear your seat-belt!
and secondly,
LISTEN and OBEY to commands from police officers, particularly when they say to STOP!

Here's the UNITED STATES COURT OF APPEALS FOR THE NINTH CIRCUIT ruling in Bryan v Coronado Police, et al
CONCLUSION
  • Viewing the facts, as we must, in the light most favorable to Bryan, we conclude, for the purposes of summary judgment, that Officer MacPherson used unconstitutionally excessive force. However, a reasonable officer confronting the circumstances faced by Officer MacPherson on July 24, 2005, could have made a reasonable mistake of law in believing the use of the taser was reasonable. Accordingly we REVERSE the district court’s denial of summary judgment on the basis of qualified immunity.

REVERSED.
