McHenry Files For Continued Contempt of Court by ARAS 360

Sept 9, 2013: McHenry Software Files in US Federal Court For Continued Contempt of Court by ARAS 360
On June 26, 2013 a status hearing was held in US District Court in front of the Honorable Judge Terrence Boyle. At the hearing McHenry Software demonstrated that ARAS 360 Technologies was in contempt of court due to continued violation of the US Federal Injunction and Contempt Order due to:
  • (1) That ARAS 360 continued to have references to McHenry and/or Brian McHenry on their website
    (2) That ARAS 360 has not provided a complete and accurate list of sales of the Collide software, including the date on which the sale occurred
    (3) That ARAS 360 continues to have unexplained license serial numbers which represent continued use, duplication and transmission of McHenry DLLs
The Honorable Judge Boyle admonished ARAS 360 for requiring 3 hearings on this matter, 2 more than should have been required. He then requested McHenry Software file our paperwork and he would rule accordingly.

October 9, 2013: Today McHenry Software filed an amended motion for continued contempt against ARAS 360 TECHNOLOGIES, INC.:
  • NOW COMES Plaintiff, MCHENRY SOFTWARE, INC. (“McHenry Software”), by and through its attorneys, Ortiz & Schick, PLLC, and respectfully moves that this Court enter an Order:
    • i) directing Defendant ARAS 360 TECHNOLOGIES, INC.(“ARAS 360”) to appear and show cause why it should not be held in contempt for violating this Court’s direct Orders;
      ii) further enforcing the injunction against ARAS 360;
      iii) requiring ARAS 360 to provide a list of all sales and license keys, activated and non-activated, for the Collide product, including username and date, certified by ARAS 360 president Mike Kennedy as complete and accurate;
      iv) granting McHenry Software attorney’s fees and costs incurred;
      v) assessing ARAS 360 a penalty of $1,000.00 (ONE THOUSAND DOLLARS) a day for each day that it continued to violate the Preliminary Injunction after this Court’s entry of the Contempt Order and
      vi) granting such further relief as this Court deems necessary and appropriate.
    The grounds for this Motion are set forth in the Memorandum filed concurrently herewith.
