McHenry Appeal hearing delayed due to 11 month delay in arbitrator Cost ruling

On May 26, 2014 McHenry Software filed an appeal of the award in the Supreme Court of British Columbia in the matter McHenry Software vs ARAS 360 lawsuit.
  • The appeal has not been put on the docket due to an unexplained 11 month (and counting) delay in the completion of the ruling on Cost by the arbitrator J. Gary Fitzpatrick, Q.C..
    All filings were provided to Mr. Fitzpatrick by October 8, 2014.
    This arbitration was originally filed in December 2012
    The arbitration was heard in November 2013 and final arguments in January 2014.
    Final submissions on cost were submitted in early Oct 2014.
A further complicating factor in this lawsuit is that ARAS360, although still involved in this lawsuit, was bought by publicly traded company FARO on February 5, 2015
  • McHenry Software made several attempts to engage FARO in discussions to remedy this lawsuit however FARO has not initiated any discussion
