Very similar to a situation In 2003, wherein a court found that a prosecutor in Queens had lied and tolerated lies by witnesses in order to convict Shih-Wei Su of a pool-hall murder.
Marvin Schechter, a defense lawyer and chairman of the criminal justice section of the New York State Bar Association, wrote a column recently on The Brady dilemma stating that
- "wrongful convictions continue to be uncovered nationwide".
- (1) disclosure of evidence favorable to the accused,
(2) that it be revealed in ,1 timely manner so as to permit the defense to use the information effectively, and
(3) that such evidence is not limited solely to evidence which supports the defendant's trial theory but includes evidence which bears on the trial strategy
